Marriage Agreements
Marriage Agreements
Marriage Agreements, also known as antenuptial contracts or prenuptial agreements, are legal documents entered into by couples before getting married to regulate their property rights and other aspects of their relationships. In South Africa, there are two types of marriage contracts, ante-nuptial contracts with accrual and ante-nuptial contracts without accrual.
An ante-nuptial contract with accrual allows couples to specify how their assets will be divided in the event of divorce, taking into account the increase in their respective estates during the marriage.
As divorce Attorneys it is vital to help clients/couples understand the implications of different types of marriage agreements and assist them in drafting customized contracts that reflect their wishes and protect their financial interest
