Common Law Cohabitation
Common law cohabitation refers to unmarried couples who live together in a romantic or domestic relationship without undergoing a formal marriage ceremony. Cohabiting partners may share a home, finances, and parenting responsibilities.
Legal Status
Common law cohabitation does not have legal recognition in South Africa, and cohabiting partners do not enjoy the same rights and protections as married couples.
However, they may have certain rights and obligations based on their contributions and agreements made during the relationship
Financial Arrangements
Common law partners may choose to pool their finances and assets, but they do not automatically acquire joint ownership of property acquired during the relationship.
Disputes over property ownership may arise if the relationship ends.
Legal Agreements
Common law cohabiting partners may wish to enter into cohabitation agreements or domestic partnership agreements to clarify their rights and responsibilities towards each other, including property ownership, financial support, and child custody arrangements.
